Privacy Policy

Barron Law (“we”, “us”, “our”) is the criminal law practice of David Barron, solicitor, at 88 Fitzmaurice Street, Wagga Wagga NSW 2650. This policy explains how we collect, use, store and disclose personal information, including through this website.

We handle personal information in line with the Australian Privacy Principles in the Privacy Act 1988 (Cth). As solicitors, we also owe our clients a duty of confidentiality under the Legal Profession Uniform Law (NSW) and the Australian Solicitors’ Conduct Rules. Where that duty, or legal professional privilege, gives you greater protection than this policy, it applies.

What we collect

Depending on how you deal with us, we may collect:

  • your name, phone number, email address and postal address
  • details of your legal matter, such as charges, court dates, bail conditions and related documents
  • information about other people involved in your matter, such as co-accused, witnesses, complainants or family members
  • identification and billing details if you become a client
  • technical information when you visit this website (see “Website and cookies” below)

Some of this is sensitive information under the Privacy Act, in particular information about criminal records and allegations, and sometimes health information that is relevant to your matter, such as reports used in sentencing. We only collect sensitive information with your consent or where the law allows it, and only when we need it to act for you.

You can make a general enquiry without giving your name, or using a pseudonym. We will generally need to know who you are before we can advise you or act for you.

How we collect it

Where we can, we collect personal information directly from you: when you call us, meet with us, use the enquiry form on this website, email us or give us documents. In the course of your matter we may also collect it from others, such as police, prosecutors, courts, other lawyers, experts and people you ask us to speak with.

Enquiries through this website

When you use our enquiry form, we receive your name, phone number, email address, the type of matter and your message. The enquiry is emailed to our office, and a copy is stored on the server that hosts this website.

Please keep your message brief and general, for example the type of charge and your next court date. We will discuss the details with you in confidence when we call you back.

Documents you upload

When you use our document upload page, we receive your name, phone number, email address, the files you attach and any note you add. The files are emailed to our office and kept on our web server in a folder that is not publicly accessible. We use them only for your matter.

Sending an enquiry or uploading documents does not make you our client. See our Terms and Conditions.

How we use it

We use personal information to:

  • respond to your enquiry and work out whether we can act for you, including checking for conflicts of interest
  • provide legal services and represent you
  • communicate with you, the courts and other parties about your matter
  • bill for our services
  • meet our legal and professional obligations, including keeping records
  • run this website and keep it secure

We do not sell personal information, and we do not use it for marketing.

Who we disclose it to

We only disclose personal information for the purposes above, or where the law requires or allows it. This may include:

  • courts, tribunals, police and prosecuting authorities, in the course of your matter
  • barristers, experts, interpreters and other professionals we engage for your matter
  • legal aid or other funding bodies, if you apply for funding
  • our professional indemnity insurer, auditors and regulators, such as the Law Society of New South Wales and the Office of the Legal Services Commissioner
  • businesses that support our practice, such as IT, email, website hosting and document storage providers, who must keep it confidential

Information sent overseas

We do not deliberately send personal information overseas. Some of our technology providers, such as email, cloud storage and website security services, may store or process data outside Australia, including in the United States. Where that happens, we take reasonable steps to make sure they protect it.

Website and cookies

When you visit this website, our hosting and security providers automatically record technical information such as your IP address, browser type and the pages you view. We use this to keep the site running and to protect it from spam and misuse. The site is protected by Cloudflare, which may set cookies that are needed for security.

We use Google Analytics to understand, in aggregate, how people use the website. It uses cookies to record things like the pages you visit and how long you stay. It does not tell us who you are. You can opt out with Google’s opt-out browser add-on or by blocking cookies in your browser.

We do not use advertising or remarketing cookies.

Our contact page includes a Google Map. When it loads, Google may collect information such as your IP address and set cookies, under Google’s privacy policy.

Links to other websites are covered by those websites’ own privacy policies.

Storage and security

We keep personal information in electronic and paper files, and take reasonable steps to protect it from misuse, interference, loss, and unauthorised access or disclosure. Information sent through this website is encrypted in transit. No transmission over the internet is completely secure, so if you would rather not use the form, please call us.

We keep client files for as long as the law and our professional obligations require, then destroy them securely.

If a data breach is likely to cause you serious harm, we will tell you, and we will notify the Office of the Australian Information Commissioner where required.

Access and correction

You can ask us for access to the personal information we hold about you, or ask us to correct it. We will respond within 30 days. We may refuse access where the law allows, for example where it would affect another person’s privacy or legal professional privilege. If we do, we will tell you why.

Complaints

If you are concerned about how we have handled your personal information, please contact us first, and we will respond within 30 days. If you are not satisfied with our response, you can complain to the Office of the Australian Information Commissioner at www.oaic.gov.au or on 1300 363 992.
